Welcome to Freak

These Terms & Conditions ("Terms") explain how Freak works and what you agree to when you use the Freak app ("App").

By creating an account or using Freak, you agree to these Terms.

1. About Freak

Freak is a fashion resale marketplace that helps people buy and sell fashion items safely.

  • Sellers list their items on Freak

  • Buyers place orders through the App

  • Freak handles the process in between, including pickup, inspection, optional authentication, delivery, and payment coordination

Freak does not own the items listed on the App. Items belong to sellers until they are successfully delivered and kept by buyers. Freak acts solely as a marketplace facilitator connecting buyers and sellers and is not the seller, owner, or manufacturer of any listed items.

2. Who Can Use Freak

  • You must be at least 14 years old to use Freak

  • If you are under 18, you confirm you have permission from a parent or guardian

  • You must provide accurate and up-to-date information when creating an account

You are responsible for all activity on your account.

3. Listings & Seller Responsibility

Seller Responsibilities

Sellers are responsible for ensuring that:

  • They own the item

  • The item is accurately described

  • The item matches the photos shown

  • The item is authentic (where applicable)

Until an item is sold, it remains with the seller.

Once Freak collects an item, Freak is responsible for handling it during:

  • Pickup

  • Inspection

  • Authentication (if requested)

  • Delivery

If an order is cancelled or an item is returned, responsibility transfers back to the seller once the item is returned to them.

4. What Can Be Listed on Freak

Freak currently supports fashion items only.

Allowed

  • Clothing

  • Shoes

  • Bags

  • Fashion accessories

Special Conditions

  • Cosmetics, skincare, and personal care items must be brand new and unused

  • Lingerie and intimate items must be brand new with original tags

Not Allowed

  • Illegal items of any kind

  • Weapons or weapon-like items

  • Counterfeit or fake goods

  • Items outside approved fashion categories

  • Items that violate local laws or regulations

Freak may remove listings that violate these rules and take action against the account.

5. Orders, Pickup & Inspection

When a buyer places an order:

  • Freak confirms the order

  • Freak arranges pickup from the seller

  • The item is sent to Freak's sorting center for inspection

If an item does not match the listing:

  • The order is cancelled

  • The item is returned to the seller

6. Try-Before-You-Buy & Returns

Freak offers a try-before-you-buy experience at delivery.

Buyers may try the item only while the courier is present.

If the buyer keeps the item → the order is completed and payment is made.

If the buyer does not want the item → it must be returned immediately to the courier in the same condition.

⚠ Returns are not allowed after the courier leaves.

If an item is damaged, torn, or altered during try-on, the buyer is responsible for the damage, and the order may be completed accordingly. Freak reserves the right to refuse a return or complete the order if the item is not returned in the same condition as delivered.

Delivery & Handling Fees

A delivery fee is charged per completed delivery attempt.

If an order is not accepted, a refusal fee will apply.

When multiple items are ordered and delivered together, the delivery fee is applied once per delivery.

To ensure a smooth and fair experience for all users, additional handling rules may apply to accounts with frequent return activity. These may include:

  • Applying a pickup fee per order that is not accepted when multiple orders are placed

  • Limiting the number of active (open) orders at a given time

These measures reflect the operational cost of handling multiple items, help maintain the availability of the try-before-you-buy experience, and protect the experience for both buyers and sellers.

Freak reserves the right to apply these measures where necessary to ensure service quality, operational efficiency, and a balanced experience across the platform.

7. Authentication (Optional)

For selected items, Freak offers authentication through trusted third-party authentication partners.

Authentication:

  • Is optional

  • Is requested after placing an order

  • Happens before delivery

Outcomes

  • If the item passes authentication → it is delivered to the buyer

  • If the item does not pass authentication → the order is cancelled, the buyer is fully refunded, and the item is returned to the seller

Authentication is based on expert assessment using available information at the time of inspection and is intended to help buyers shop with confidence.

Repeated Failures

Sellers whose items repeatedly fail authentication may face:

  • Reduced discoverability

  • Temporary suspension

  • Permanent account termination in serious cases

8. Payments & Payouts

Payments

Buyers may pay via:

  • Cash on delivery

  • Wallets / InstaPay

  • Card payment via courier POS (where available)

  • In-app payments (as rolled out)

Seller Payouts

  • Sellers are paid twice per month

  • Payouts are made via bank transfer

  • Orders must be completed and kept by the buyer before payout

9. Order Updates & Communication

Freak provides order updates through:

  • In-app status updates

  • Push notifications

  • WhatsApp messages when needed for coordination

Orders can be tracked at every stage through the App.

10. Your Content & How Freak Can Use It

When you use Freak, you may upload content such as photos, videos, descriptions, messages, and listings ("Content").

You own your Content.

By uploading Content to Freak, you give Freak permission to use it only to operate, improve, and promote the Freak marketplace, including:

  • Showing your listings to other users

  • Featuring items on Freak

  • Promoting listings on and off the platform (including social media and advertising)

Content is always shown in the context of the item being sold, and not as a personal endorsement by you.

11. Using Freak Responsibly

To keep Freak safe and trusted, users must:

  • Follow these Terms and applicable laws

  • Provide accurate information

Users must not:

  • List fake, misleading, or illegal items

  • Attempt to bypass Freak's payment or delivery process

  • Re-list items repeatedly to manipulate visibility

  • Scrape or misuse app content

  • Harass or abuse other users or Freak staff

  • Use Freak to promote unrelated businesses or services

12. Freak's Right to Take Action

If Freak becomes aware of activity that violates these Terms or the law, Freak may:

  • Send warnings

  • Edit, hide, or remove listings

  • Reduce item visibility

  • Limit access to features

  • Suspend or terminate accounts

In serious cases, Freak may cooperate with legal authorities.

13. Data & Privacy

Freak respects your privacy.

Please review our Privacy Policy to understand how we collect, use, and protect your personal data.

14. Changes to These Terms

We may update these Terms from time to time.

Continued use of Freak means you accept the updated Terms.

15. Promotions, Discounts & Promo Codes

Freak may offer promotional codes, discounts, or special offers from time to time ("Promotions").

  • Promo codes or discounts cannot be combined with other discounts or price reductions on the same item or order

  • Orders containing discounted items are not eligible for additional promo codes

  • Partial item cancellations are not permitted on promotional orders

  • If a promotional order is cancelled, returned, or modified, the promotion may be removed or voided

  • Promotions apply only to the item price and do not apply to delivery fees, authentication fees, service fees, or other charges unless explicitly stated

  • The value of any promotion is funded by Freak and will not reduce the seller's payout

  • Promotions are applied only to completed orders that are kept by the buyer. Returned or rejected orders are not eligible

  • Promotions have no cash value and are non-transferable

  • Freak reserves the right to cap, modify, suspend, cancel, or reverse any promotion at its sole discretion, including in cases of suspected abuse, fraud, or misuse
